Owe more than 30 billion VND in social insurance
In recent months, hundreds of workers of Hoang Sinh Import Export Joint Stock Company (abbreviated as Hoang Sinh Company, Hoa Phu Ward, Thu Dau Mot City, Binh Duong Province) have been running around asking authorities to protect their rights because the company has been owing them wages and social insurance for a long time. Up to now, Hoang Sinh Company still owes about 1,000 workers, each of whom is owed 2 to 3 months' wages.
Mr. Nguyen Duy Hieu - Deputy Director of Binh Duong Social Insurance - said that Hoang Sinh Company owes the Social Insurance up to 30.1 billion VND. The debt to the Social Insurance has lasted from April 2023 until now.
Regarding the responsibility of collecting social insurance debts, the representative of the Social Insurance Agency of Binh Duong province informed that every month the unit has sent official dispatches to urge and request the company to pay social insurance contributions in accordance with regulations to ensure the rights of employees.
Binh Duong Social Insurance and Binh Duong Provincial Police have coordinated to invite Hoang Sinh Import Export Joint Stock Company to work three times to understand the situation and social insurance payment plan. However, this company did not follow the committed plan.
On August 1, 2024, the Book and Card Collection Management Department of Binh Duong Provincial Social Insurance sent an official dispatch regarding non-payment of social insurance and health insurance to Binh Duong Provincial Police to coordinate support, take measures to prevent and handle to ensure the rights of employees.
On August 27, 2024, Binh Duong Social Insurance and many agencies invited the company to work and requested the company to report on how to handle salaries and social insurance debts as well as the appropriation of employees' money. However, to date, there has been no report and the company has not made any deductions.
After that, the People's Committee of Binh Duong province issued an official dispatch assigning the Department of Labor, Invalids and Social Affairs of Binh Duong province to preside over and work with relevant departments and agencies to promptly handle the case and ensure the legitimate rights of employees. Currently, the Department of Labor, Invalids and Social Affairs of Binh Duong province has inspected Hoang Sinh Company.
Detect a series of violations
Meanwhile, Mr. Pham Van Tuyen - Deputy Director of the Department of Labor, Invalids and Social Affairs of Binh Duong province said that Hoang Sinh Company has stopped production since October 2024. The Department has coordinated with relevant sectors to establish an inspection team to conduct inspection and verification of the implementation of labor laws, the Law on Labor Safety and Social Insurance at this unit. The inspection team has drawn up a record of administrative violations, determining that Hoang Sinh Company has committed 3 administrative violations.
Hoang Sinh Company violated the act of paying salaries on time according to the law for 858 employees from June 2024 to September 2024, the amount of 24.86 billion VND. The company is forced to pay full salaries plus interest on the late salary to employees calculated according to the highest non-term deposit interest rate of banks.
Violation of late payment of union fees from January 31, 2018 to September 30, 2024, amount of 5.61 billion VND.
Regarding compulsory social insurance, Hoang Sinh Company has committed acts of delaying the payment of compulsory social insurance and unemployment insurance. Hoang Sinh Company is required to pay the full amount of compulsory social insurance and unemployment insurance to the social insurance agency. The total fine for the above 3 acts is 390 million VND.
Workers in trouble because of unpaid wages
According to records, there are nearly 1,000 workers who are owed wages by Hoang Sinh Company. Most of them are owed 3 months of wages, ranging from 15-20 million VND. Due to the prolonged unpaid wages, the workers have run out of money to cover their living expenses. Some have to pay for rent and food. For nearly 3 months now, the workers have had to do odd jobs and seasonal jobs to make ends meet.
