Clause 1, Article 23 of the 2025 Law on Public Employees (effective from July 1, 2026) stipulates the basis for determining civil servant job positions as follows:
1. Based on determining the position of a civil servant:
a) Functions, tasks and organizational structure of public service units;
b) The level of complexity, nature, location, and scale of activities of public service units; scope and service subjects; professional and technical management processes;
c) expertise and skills of the industry, field of professional activities and expertise and skills of other industries and fields as prescribed;
d) The level of modernization of means, equipment, equipment, working conditions and application of science, technology, digital transformation.
Currently, Article 4 of Decree 106/2020/ND-CP stipulates the basis for determining job positions in public service units such as: a) Fungctions, tasks, powers, organizational structure of public service units; b) Complexity, nature, characteristics, scale of activities; scope, subjects of service; professional and technical management process according to the provisions of specialized law.
