Workers look forward to finalizing social insurance books
Mr. Ho Quoc Nghia (38 years old, residing in Dai Phuoc commune, Dong Nai city) said that he used to work at Bach Thanh Ceramic Tile Co., Ltd. but the company did not fulfill the obligation to pay social insurance for him. Therefore, he filed a lawsuit against the company in court. The People's Court of Region 2 - Dong Nai has conducted mediation between the parties, the company has agreed to pay social insurance for Mr. Nghia in the period from September 2023 to the end of September 2024.
After the court's decision, Mr. Nghia filed a request for judgment enforcement. However, up to now, the company has stopped operating, making it difficult to resolve his social insurance benefits. Mr. Nghia shared that he was the first person to sue the company from 2025. Currently, he alone is raising two children (14 years old and 16 years old). Because his social insurance book has not been closed, Mr. Nghia cannot apply for official employment at other businesses to continue paying social insurance, but can only do seasonal jobs to have income to cover living expenses and raise 2 children to study.
“The thing I desire most is to finalize my social insurance book and settle for one-time social insurance benefits according to regulations. This amount of money will help me have the conditions to rent a stable place to live, take care of my 2 children's studies and overcome the current particularly difficult period” - Mr. Nghia said angrily.
Mr. Nguyen Dang Thanh Tam (60 years old, residing in Phuoc Thien neighborhood, Nhon Trach ward, Dong Nai city) informed that he has worked at Bach Thanh Ceramic Tile Co., Ltd. for 17 years until he quit his job. Mr. Tam confided that because he is old and his social insurance book is not finalized, after quitting his job, Mr. Tam finds it difficult to find a job and has to work as a seasonal security guard. Currently, his family's life and income are very precarious. Mr. Tam hopes to have his social insurance book fully finalized to find a new job to cover his life.
The legitimate rights of workers are seriously affected
The case of Mr. Nghia and Mr. Tam is a small number among hundreds of cases of employees of Bach Thanh Ceramic Tile Co., Ltd. being affected in their rights. To date, authorized representatives of employees of Bach Thanh Ceramic Tile Co., Ltd. (supporting legal procedures for employees) have submitted 162 sets of lawsuits to the People's Court of Region 2 - Dong Nai to claim insurance benefits.
According to Nhon Trach Grassroots Social Insurance (Dong Nai City Social Insurance), Bach Thanh Ceramic Tile Co., Ltd. produces building materials from clay, produces floor tiles, wall tiles. As of the end of June 2026, the total amount of money Bach Thanh Ceramic Tile Co., Ltd. is late in paying social insurance, health insurance, unemployment insurance, and occupational accident and sickness insurance and interest is nearly 4.9 billion VND, of which late payment interest is more than 1 billion VND. The total number of employees who have not been fully certified for their participation from November 2023 to June 2026 is 339 people. According to Nhon Trach Grassroots Social Insurance, the late payment of social insurance, health insurance, unemployment insurance, and occupational accident and sickness insurance has seriously affected the legitimate rights of employees working at Bach Thanh Ceramic Tile Co., Ltd.
Mr. Vu Ngoc Ha - Labor Law expert in Dong Nai City commented: Businesses that have been slow to pay social insurance in the past have caused great difficulties for workers, causing workers' rights to be "suspended" such as: Not being able to retire, not being able to settle sickness and maternity benefits, and workers' rights are disadvantaged.
