In which, regulations on connection and data sharing with the Electronic Labor Contract Platform are based on Article 16.
Article 16. Connecting and sharing data with the Electronic Labor Contract Platform
1. National databases, specialized databases, National Data Centers, public service portals, information systems for resolving administrative procedures, integrated platforms, data sharing at ministerial and provincial levels and other information systems of state agencies, other databases connected to electronic labor contract platforms through telecommunications networks, Internet networks, computer networks, information systems in accordance with legal regulations on data connection and sharing, open data serving electronic transactions of state agencies.
2. To ensure confidentiality, security, information safety, and protect personal data when connecting and sharing information with the Electronic Labor Contract Platform, the information system of state agencies and organizations must ensure the following requirements:
a) Meeting the standards and technical regulations of information technology in connecting and sharing with the Electronic Labor Contract Platform.
b) Ensuring minimum level 3 information security according to the provisions of law on ensuring information system security by level when officially connected.
3. The connection and sharing of data according to the provisions of Clause 1 of this Article shall be carried out on the basis of written agreement between the Ministry of Home Affairs and the agency or organization managing the database and information system.
4. The Ministry of Home Affairs is responsible for notifying in writing the refusal or temporary suspension of connection and data sharing in the Electronic Labor Contract Platform in the following cases:
a) The information system of the agency or organization requesting connection does not ensure the conditions specified in Clause 2 of this Article.
b) Agencies and organizations connected to have illegal access activities, changing, deleting, destroying, and spreading information in the Electronic Labor Contract Platform.
c) Agencies and organizations connected violate regulations on protecting personal data or content agreed upon with the Ministry of Home Affairs specified in Clause 3 of this Article.
