According to Section 3 of Official Dispatch 317/SNV-XDCQCTTN in 2025, the instructions for recruiting non-professional commune-level cadres to work as civil servants are as follows:
Pursuant to Article 45 of the Law on Cadres and Civil Servants 2025 on transitional provisions; Section 3 of Official Letter 11/CV-BCD in 2025 of the Steering Committee for arranging standards for exchanging with professional and technical civil servants at the commune level (not holding leadership and management positions), the Department of Home Affairs requests the People's Committees of communes, wards and special zones to urgently review the personnel situation at their agencies and units.
In case the on-site personnel do not meet the standards and conditions for working or are still lacking in personnel according to the number of civil servants, there must be a document widely informing other agencies and units within the city to consider and receive civil servants and public employees who meet the standards and conditions to suit the requirements of the job position to be received according to regulations and according to decentralization and delegation.
In cases where information has been provided but there are no suitable personnel or the provisions of the specialized Law according to the functions and tasks of civil servants under the People's Committee at the commune level allow the reception of non-professional workers at the commune level before the effective date of Decree 170/2025/ND-CP of the Government (stipulated in Point g, Clause 1, Article 13 of Decree 170/2025/ND-CP).
The authority to receive according to the provisions of Clause 2, Article 13 of Decree 170/2025/ND-CP in case of shortage of civil servant positions after bringing in the expected number of positions as prescribed in Clause 1, Section II of Official Dispatch 09/CV-BCD in 2025.
Regarding standards, conditions for receiving and documents of proposed civil servants, implement Clause 3, Clause 4, Article 13 of Decree 170/2025/ND-CP.
