Khanh Hoa requests a plan to handle Mai Linh Nha Trang Company for prolonged unpaid wages and social insurance

Khanh Hoa - Regarding unpaid wages and social insurance at Mai Linh Nha Trang Company, Khanh Hoa province has just issued an official dispatch requesting relevant departments and units to propose a handling plan.

Khanh Hoa Provincial People's Committee assigned the Department of Home Affairs to preside over and coordinate with the Provincial Federation of Labor and relevant agencies and units to urgently inspect and report on the payment of unpaid wages to employees according to the roadmap; the implementation of Decision No. 47/QD-SNV dated April 1, 2025 of the Department of Home Affairs, Decision No. 3479/OD-XPHC dated December 31, 2024 of the Provincial People's Committee on administrative sanctions.

On that basis, propose a handling plan in case the Company still owes wages and Social Insurance (SI) for a long time. In case of exceeding the authority, the dossier shall be transferred to the competent authority for settlement in accordance with regulations.

Khanh Hoa Provincial People's Committee also requested Khanh Hoa Provincial Federation of Labor to meet, discuss, and guide employees to carry out procedures according to regulations and take measures to ensure the legitimate rights and interests of employees according to regulations.

Previously, on June 23, about 20 employees had been working at Mai Linh Nha Trang Company Limited, concentrating at 2 locations in the city to respond to the company's continuous failure to fulfill its promise to pay wages, social insurance and related documents as committed in the working minutes with authorities and employees on May 8, 2025.

Khanh Hoa Provincial Federation of Labor immediately invited 7 workers representing the collective of employees owed by the company to discuss. Here, the employee representative informed that Mai Linh Nha Trang Company Limited owes wages and social insurance for many years, owes deposits, sells vehicles to employees but still keeps the vehicle documents to mortgage to the bank...

Request the Company to resolve debts for employees, not to extend them further. In case the collective of employees requests to sue Mai Linh Nha Trang Company Limited in court, the Provincial Federation of Labor and competent authorities will guide the procedures for filing the lawsuit.

On May 8, the Provincial Federation of Labor, the Department of Home Affairs, and the collective of employees with unpaid wages and social insurance had a dialogue with representatives of Mai Linh Nha Trang Company.

According to the record, the company representative committed to paying salaries, social insurance regimes and vehicle documents for some cases before May 31 and had a payment schedule before August 8. However, after May 31, 3 cases of workers in particular difficulties were still not resolved. After the Khanh Hoa Provincial Federation of Labor issued an official dispatch requesting the company to fulfill its commitment and Lao Dong Newspaper published an article reflecting, the company was able to settle more than 100 million VND to pay salaries to some workers. And continue to commit to paying social insurance debts and vehicle documents to employees on June 20.

As of the morning of June 23, the workers had not yet been resolved as committed, so they went to the company. On the afternoon of June 23, Mai Linh Nha Trang Company paid more than 150 million VND and closed social insurance books for 2 cases (1 person has died and 1 case in especially difficult circumstances).

On June 6, the People's Committee of Khanh Hoa province issued a document requesting the Department of Home Affairs to check and verify information related to unpaid wages and social insurance of Mai Linh Nha Trang Company in Lao Dong Newspaper.

According to the Department of Home Affairs of Khanh Hoa province, the results of the inspection and verification of unpaid wages and social insurance according to the reflection of employees at the Company in April 2025, the Company paid wages on time according to the provisions of law to 90 employees. Of which, 49 workers have quit their jobs. Most workers are owed wages for 1 to 8 months.

The Inspectorate of the Department of Home Affairs has prepared a fine of VND 50 million and applied remedial measures, forcing the Company to pay the full unpaid wages to 90 employees according to regulations within 30 days from the date of receipt of the Decision.

Regarding late payment of social insurance, the total debt as of March 2025 is VND 596,544,441. The company implements social insurance regimes for employees who are not fully compulsory. Khanh Hoa Provincial People's Committee has issued a Decision to sanction administrative violations with a total fine of VND 97,284,012.
