Article 16 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023 stipulates as follows:
Security and Order Protection Team; members of the Security and Order Protection Team
1. The security and order protection team includes the Team Leader, Deputy Team Leader and Team Member.
2. Commune-level police report to the Chairman of the People's Committee at the same level to issue a decision to establish a Security and Order Protection Team, a decision to recognize a member of the Security and Order Protection Team and be publicly posted.
3. In the village, the residential group has appointed the Captain and Deputy Captain of the People's Public Security Team according to the provisions of the law on fire prevention and fighting, the Commune-level Police shall base on the capacity and professional qualifications of the appointed person to propose to the Chairman of the Commune-level People's Committee for consideration and decision to recognize him as the Captain and Deputy Captain of the Security and Order Protection Team.

Thus, according to the above provisions, the Security and Order Protection Team is established by the Chairman of the People's Committee at the commune level.
