Leaving work for more than 1 year and still owing salary
According to the list of employees who used to work at the general company, there are 26 people owed with a total amount of 1,444,691,158 VND. The person who is owed the most salary by the company is 120 million VND; the lowest person is 5 million VND.
According to the complaint, they are all people who have terminated their labor contracts and have repeatedly reported the issue to the company since the termination of the labor contract, but up to this point, they have not yet received the salaries, wages and allowances that the company is obligated to pay to employees.
Mr. To Hong Chung is one of the people who reflected being owed salaries by the company. Mr. Chung said that on April 8, 2024, he signed a 1-year labor contract with the company.
According to Mr. Chung, throughout the working process, he was not disciplined with labor, did not violate the company's internal regulations and rules. However, the company is owing his salary, including: April 2024 salary of more than 14.8 million VND; November 2024 salary (more than 20.6 million VND); December 2024 (more than 20.6 million VND); January 2025 (more than 14.6 million VND). In addition, according to Mr. Chung, the company is also owing him more than 3.9 million VND for meals in October, November, December 2024 and 950,000 VND for meals in January 2025.
Mr. Chung added that on January 23, 2025, he and the company signed a labor contract liquidation record. Mr. Chung said that a year after the labor contract was paid, he had not yet received 75.7 million VND of the company's salary debt (except for a sum of 3 million VND that the company transferred to him on August 7, 2025).
Another case reflecting being owed salaries by the company is Mr. Vu Thanh Truong, who has worked as an accountant at the company for 1.5 years.
Mr. Truong said that since he quit his job (January 2025) until now, the company still owes him 5 months' salary with the amount of 50 million VND.According to Mr. Truong, when he asked about the issue of salary debt, there was no answer from senior leaders in the company; intermediate leaders encouraged "the money is coming back soon"...
Being owed salary, especially after terminating labor contracts, has made the lives of many workers difficult; some workers have to borrow money to cover living expenses...
Company leaders made an appointment to work with reporters and then said... forgot
To have objective and multi-dimensional information about workers' reflections, on January 19, a reporter from Lao Dong Newspaper called and texted Mr. Cao Van Lam - Director of the company but received no response.
Reporters continued to call Mr. Nguyen Ngoc Duong - Chairman of the Company's Board of Directors. Mr. Duong said: "Just go to the company office to work". When asked about the time, Mr. Duong said that he would make an appointment and would contact him again. However, reporters did not receive a response afterwards.
On January 21, reporters texted back once again to Mr. Nguyen Ngoc Duong's phone number and received an invitation to work at the company on Monday morning (January 26).
At 10 am on January 26, reporters came to the company's headquarters at The Light building on To Huu street, but company staff said that Mr. Nguyen Ngoc Duong was not present at the office.
After that, the reporter received a text message from Mr. Nguyen Ngoc Duong, saying that he "forgot his schedule, just landed at the airport", and asked to book an appointment to meet the reporter at 10 am on January 27.
According to the provisions of Article 94 of the 2019 Labor Code, employers must pay salaries directly, fully, and on time to employees. Clause 4, Article 97 of the 2019 Labor Code stipulates that in cases where due to force majeure reasons, employers have taken all measures to remedy but cannot pay salaries on time, they are not allowed to delay more than 30 days; if salary payment is delayed by 15 days or more, employers must compensate employees with an amount of money at least equal to the interest of the delayed payment calculated according to the interest rate on 1-month term deposits mobilized by the bank where the employer opened a salary payment account for employees announced at the time of payment.
