Clause 1, Article 26 of the 2025 Law on Employment clearly stipulates:
Workers in occupations or jobs that directly affect the safety and health of workers or the community must have a national vocational skills certificate.
In addition, Clause 2, Article 26 states:
"The Government issues a list of occupations and jobs that require a national vocational skills certificate."
Thus, the recognition of mandatory vocational skills for jobs with dangerous and risk factors will be specifically regulated by the Government through the list.
Previously, the 2013 Law on Employment did not have equivalent provisions. Although the old law stipulates national vocational skills certificates (in Articles 59, 60, 61), it is not mandatory for employees to have certificates for any occupational group.
The assessment and issuance of certificates is encouraging, without mandatory factors as stipulated in the new regulations in the 2025 Employment Law.
