Article 4 of Decree 120/2020/ND-CP stipulates the principles of establishing, reorganizing, and dissolving public service units as follows:
- The establishment, reorganization, and dissolution of public service units must ensure compliance with the conditions, procedures, order, and authority prescribed in Decree 120/2020/ND-CP (in case the specialized law has other provisions, it shall comply with the provisions of the specialized law); a public service unit can provide many public service services of the same type.
- Newly established public service units (including public service units under public service units) must self-insure regular expenditures and investment expenditures (except in cases where newly established units must provide basic and essential public service services). For public service units under public service units that are self-sufficient in regular expenditures and investment expenditures, when newly established (including the provision of basic and essential public service services), they must self-sufficient in regular expenditures and investment expenditures.
- Public service units that are not operating effectively will be reorganized or dissolved. The reorganization of public service units must not increase the number of people receiving salaries from the state budget approved by competent authorities, ensuring compliance with regulations on the number of deputy heads of the unit and streamlining the payroll according to regulations.
