Decree No. 178/2024/ND-CP stipulates policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system.
The subjects of application of this Decree include:
1. Cadres, civil servants, public employees, and people working under labor contracts in agencies, organizations, units and armed forces due to the reorganization of the apparatus and administrative units at all levels as prescribed in Article 1 of this Decree, including:
a) Cadres, civil servants, public employees in leadership, management and civil servants, public employees;
b) Commune-level cadres and civil servants;
c) People working under labor contracts according to the provisions of labor law before January 15, 2019 and people working under labor contracts are subject to the same policy as civil servants;
d) Officers, professional soldiers, workers and defense officials of the Vietnam People's Army;
d) Officers, non-commissioned officers receiving salaries, police workers and contract workers receiving salaries from the state budget under the People's Public Security;
e) People working in key organizations.
2. Cadres who are not eligible for re-election or reappointment to hold positions and titles according to their terms in agencies of the Communist Party of Vietnam, the State, socio-political organizations and cadres who resign at will shall comply with the provisions of other Decrees of the Government.
Thus, cases of working in communes and villages not subject to Decree 178 include: Part-time workers at the commune level; part-time workers in villages and residential groups.
According to the provisions of Decree 33/2023/ND-CP, the Provincial People's Committee submitted to the People's Councils at the same level to specify the title of part-time worker at the commune level.
For example, in Hanoi, according to Resolution No. 18/2023/NQ-HDND of the Hanoi People's Council, the title of non-professional activist at the commune level includes 10 positions: Office of the Commune Party Committee; Head of commune-level communication work; Deputy Commander of the Military; Vice President of the Fatherland Front; Vice President of the Veterans Association; Vice President of the Women's Union; Vice President of the Farmers' Association (for communes and wards and towns with farmers' associations); Deputy Secretary of the Ho Chi Minh Communist Youth Union; Chairman of the Association of the Elderly; Chairman of the Red Cross Society in communes, wards and towns.
In addition, according to Decree 33/2023/ND-CP, part-time workers in villages and residential groups with no more than 3 positions (including Party cell secretary, village chief or residential group leader, head of the Front Working Committee) are entitled to monthly allowances.
