Special lawsuit
On September 14, at the courtroom of the People's Court of Region 6 - Quang Ninh, a special lawsuit took place. The plaintiff is not a worker or insurance agency, but the People's Procuracy of Region 6, under the People's Procuracy of Quang Ninh City.
The defendant is Dang Quyen Co., Ltd., located in Dai Dien neighborhood, Quang Ha commune, Quang Ninh city.
This is the first lawsuit to claim social insurance debt in Quang Ninh to protect public interests according to Resolution No. 205/2025/QH15 dated June 24, 2025 of the National Assembly on piloting the People's Procuracy to initiate civil cases to protect the civil rights of vulnerable groups or protect public interests.
According to the case file, from June 2021 to now, Dang Quyen Co., Ltd. has not paid social insurance money to Quang Ha Grassroots Social Insurance.
At the trial, after considering all documents and evidence in the case file that were publicly verified and examined, listening to the opinions presented by the parties and the results of the debate, the Trial Panel determined that Dang Quyen Co., Ltd. had prolonged social insurance debt.
Although the enterprise has been urged and requested to rectify by the Social Insurance agency and the People's Procuracy of Region 6, it still does not fully comply.
According to the Trial Panel, the enterprise's violations not only directly infringe upon the legitimate rights and interests of employees but also seriously affect social security policies - public interests that need to be protected by law.
At the end of the trial, the People's Court of Region 6 ordered Dang Quyen Co., Ltd. to immediately pay the outstanding social insurance amount as of September 14, 2026, which is 61,944,812 VND to Quang Ha Grassroots Social Insurance, Quang Ninh city.
From September 14, 2026, Dang Quyen Co., Ltd. must continue to pay social insurance late payment interest according to the provisions of the Law on Social Insurance until it fully pays the social insurance amount and other revenues. The enterprise must also bear 3,097,240 VND of civil first-instance court fees.
Widespread deployment
Quang Ninh is 1 of 6 localities nationwide assigned to implement the resolution on piloting the People's Procuracy to initiate civil cases to protect the civil rights of vulnerable groups and public interests, including the issue of insurance debt.
Right from the beginning of 2026, the People's Procuracy of Quang Ninh city has coordinated with the insurance agency to gradually deploy widely throughout the province.
One of the clearest changes is that the amount of insurance debt paid back by businesses to the Social Insurance Fund is increasing.
By September 15, 2026, according to Mr. Nguyen Huy Thong - Deputy Director of Quang Ninh Provincial Social Insurance, the total amount of insurance debt repaid by businesses to the Social Insurance Fund is about 23 billion VND.
The above figures show that the impact of the lawsuit mechanism is not only in the judgments issued in court. Before a case is brought to trial, the insurance agency's coordination with the People's Procuracy to review, prepare dossiers and request businesses to fulfill their obligations has created pressure for many units to proactively remedy.
Currently, Quang Ninh City Social Insurance in coordination with Quang Ninh City People's Procuracy continues to verify a number of units to file lawsuits in court.
From the first trial in Quang Ha, the new mechanism is gradually creating an additional legal tool to protect workers' rights and public interests, while forcing businesses to fully fulfill their responsibilities for insurance money, which belongs to workers, and social security policies.
