The document stated that, in order to implement Official Dispatch 12/CV-BCD in 2025, in cases where the Party Committee and authorities of the ward, commune, or special zone do not have a temporary need to continue to employ part-time workers at the commune level until May 31, 2026, or part-time workers at the commune level who wish to retire when implementing the 2-level local government model according to the provisions of the Law on Organization of Local Government 2025, they will enjoy the policy according to the provisions of Article 9 of Decree 154/2025/ND-CP.
To increase proactiveness and promptly resolve the regimes and policies according to the provisions of Decree 154/2025/ND-CP, the Department of Home Affairs is coordinating with relevant agencies and units to collect opinions, synthesize and submit to the Chairman of the City People's Committee to issue a Decision authorizing the People's Committees of communes, wards and special zones to approve the list of subjects for staff streamlining and funding for staff streamlining of agencies, organizations and units under their management according to Decree 154/2025/ND-CP.
After the City People's Committee issues the authorization decision, the Department of Home Affairs will continue to implement and provide specific instructions.
At the same time, the People's Committees of wards, communes and special zones proactively review and receive applications for leave from cases of non-professional workers who wish to enjoy the policies and regimes prescribed in Article 9 of Decree 154/2025/ND-CP to estimate the payment level to promptly resolve when there is a Decision authorizing the City People's Committee.
Pursuant to Clause 6, Clause 7, Article 3 and Clause 4, Article 9 of Decree 154/2025/ND-CP, part-time workers at the commune level (old) are not allowed to be assigned to work as part-time workers in neighborhoods and hamlets according to the provisions of Article 9 of Decree 154/2025/ND-CP.
In case of meeting the conditions for enjoying policies under different Government documents, only one policy will be resolved at the highest level.
Within 60 months from the date of settlement of the regime and policies, if elected or re-recruited to agencies, organizations, and units receiving salaries from the State budget or arranged as part-time workers in neighborhoods and hamlets, the subsidy received must be refunded to the agency, organization, or unit that paid the subsidy.
