Article 5 of Decree No. 37/2014/ND-CP stipulates:

2. The deputy head of a professional agency under the People's Committee at the district level (hereinafter referred to as the Deputy Head of Department) is the person who assists the Head of Department in directing certain aspects of work and is responsible to the Head of Department for assigned tasks. When the Head of Department is absent, a Deputy Head of Department is authorized by the Head of Department to manage the activities of the department.
3. The number of Deputy Heads of specialized departments under the People's Committee at district level shall not exceed 3 people.
4. The appointment, transfer, rotation, reward, discipline, dismissal, resignation, implementation of regimes and policies for the Head of Department and Deputy Head of Department are decided by the Chairman of the District People's Committee according to the provisions of law.
Clause 3, Article 5 (the number of Deputy Heads of specialized agencies under the People's Committee at the district level is not more than 3 people) is amended by Clause 3, Article 1 of Decree 108/2020/ND-CP (effective from November 25, 2020) as follows:
3.Number of Deputy Heads of Departments: On average, each department has 2 Deputy Heads of Departments.
Based on the number of established specialized departments and the total number of Deputy Heads of Departments, the People's Committee at the district level shall decide on the specific number of Deputy Heads of Departments of each specialized department accordingly."
