Cutting 8 procedures, switching to capacity announcement
At the policy communication conference on the Draft Law amending and supplementing a number of articles of the Law on Measurement organized by the Ministry of Science and Technology on August 19, Mr. Tran Quy Giau - Head of the Measurement Committee, National Standards Committee for Measurement and Quality (Ministry of Science and Technology) said that the draft Law creates a basis for reducing and simplifying 8 administrative procedures in detailed regulations.
Among these, there are 3 procedures for registering service activities for group 1 and non-standard measuring instruments for direct inspection of group 2 measuring instruments; 3 procedures for certifying standards used directly for inspection of group 2 measuring instruments and 2 procedures for quantitative marks.
Mr. Giau said that the draft Law amending and supplementing a number of articles of the Law on Measurement also proposes to abolish business conditions and procedures for registration of operations for measurement services for group 1 measuring instruments. This regulation also applies to measurement services for measurement standards not directly used to inspect group 2 measuring instruments.
Regarding working standards, standard substances used directly for testing group 2 measuring instruments, the draft proposes to abolish certification and switch to announcing technical conformity.
The draft also proposes to abolish the certificate of eligibility for using quantitative marks and the obligation to express quantitative marks.
Another content is to abolish the classification of pre-packaged goods of group 1, group 2 and integrate regulations in Article 32.
Along with the above reduction contents, state inspection is proposed to be carried out based on risk assessment, focusing on subjects and fields with high risk of violations.
Expanding the rights and interests of people, organizations, and businesses
According to Mr. Tran Quy Giau, the draft Law also proposes a number of contents to expand or continue to ensure the legitimate rights and interests of people, organizations and businesses.
In which, the standard invested by organizations and businesses may be considered and approved as a national measurement standard when meeting the requirements. Subjects entitled to this content include businesses, research institutes and universities.
The draft also proposes to encourage and support organizations and businesses to develop measurement assurance programs. Implementation results are considered when assessing risks and determining the focus of inspection.
For organizations providing measurement services, the draft proposes to shift from the conditions for registering operations to announcing capacity for services for group 1 measuring instruments and measurement standards not directly used to inspect group 2 measuring instruments. Organizations providing services are self-responsible.

The draft also ensures the right to choose inspection, standardization, and testing organizations for group 1 measuring instruments that operate legally for organizations and individuals producing, importing, and using measuring instruments.
Another content is that electronic measurement results are authenticated by digital signatures or other electronic authentication methods with legal value such as paper documents. Organizations, businesses, and people have the right to exploit and use data within the scope and conditions prescribed by law.
The draft supplements the act of prohibiting hardware and software interference or forging protection and sealing measures to falsify measurement results.
Regarding inspection work in the area, the draft proposes assigning the Chairman of the Commune-level People's Committee to preside over inspection at markets, commercial centers and points of sale of people's goods.
According to the content shared by Mr. Tran Quy Giau, the above proposals are in the group of new regulations, amended, supplemented, and repealed compared to current regulations on the legitimate rights, interests and obligations of people, organizations, and businesses.
