Can people without a teaching degree register for extra teaching business?
Youme Law Firm LLC replied: Previously, Article 8 of Circular 17 2012 of the Ministry of Education and Training had a number of regulations on requirements for extra-curricular teachers and extra-curricular teachers such as meeting the standard training level for each level of education according to the provisions of the Education Law, having good health, and having good moral qualities.
However, these requirements have been abolished by the Ministry of Education and Training in Decision 2499 of the Ministry of Education and Training in 2019 and there are no replacement regulations.
From February 14, 2025, Article 6 of Circular 29/2024 of the Ministry of Education and Training stipulates that organizations or individuals organizing extra-curricular teaching and learning activities with fees from students must register their business in accordance with the provisions of law.
Currently, the professional code for extra teaching and learning is the tutoring services (guidance) according to Appendix II of Decision 27/2018 on the Vietnamese economic sector system, which is another group of education that has not been classified (medicine code 8559) is not currently on the list of conditional business lines in the Investment Law.
Particularly for the business model of foreign language and IT centers, Circular 21/2018 of the Ministry of Education and Training requires the center director to meet the requirements for qualifications but not necessarily have a pedagogical degree:
Graduated from a university in a foreign language or university and have a minimum foreign language certificate of level 3 according to the 6-level Foreign Language Competency framework for Vietnam or equivalent (for directors of foreign language centers).
Graduated from a university in information technology or university and have a certificate of basic information technology application according to the Information Technology Skills standard or equivalent according to current regulations of the Ministry of Education and Training and the Ministry of Information and Communications (for the director of the information technology center).
Thus, according to current regulations, people without a pedagogical degree can register for extra teaching business.
Cases where extra classes are not allowed, extra classes are organized
According to Article 4 of Circular 29/2024, cases that are not allowed to teach extra classes from February 14, 2025 include:
No extra teaching is organized for primary school students, except in the following cases: training in arts, physical education, life skills training.
Teachers who are teaching at schools are not allowed to teach extra classes outside of school with fees collected from students that the teacher is assigned to teach according to the school's education plan.
Teachers in public schools are not allowed to participate in managing and operating extra teaching outside of school, but can participate in extra teaching outside of school.
