The Government has issued Decree 151/2025/ND-CP regulating the division of authority of local authorities at 2 levels, decentralization of authority, and delegation of authority in the land sector. This Decree takes effect from July 1, 2025.
Appendix I issued with Decree 151 stipulates 8 cases of issuance and exchange of issued land use right certificates.
Accordingly, first, when the land user needs to change the land use right certificate (red book) issued before August 1, 2024 to a land use right certificate, ownership of assets attached to the land.
Second, the issued red book is stained, blurred, torn, or damaged.
Third, the red book has been issued for many plots of land in common, but the land user needs to issue a separate certificate for each plot. In addition, it applies to cases where a certificate is granted to multiple plots of land, but one or a number of plots of which are subject to revocation of the certificate according to Point d, d, e, Clause 2 and Clause 5, Article 152 of the Land Law.
Fourth, the land use purpose is not in accordance with the land use purpose classified in Article 9 of the Land Law and the decree guiding its implementation.
The fifth is that the location of the land plot on the issued red book is not accurate compared to the actual location of land use at the time of issuance of the book.
Sixth, land use rights, ownership rights of assets attached to land are the common property of the husband and wife, but the issued red book only records the full name of the husband or wife, now there is a requirement to issue a new one to record the full full name of both husband and wife.
Seventh, the issued certificate records the household's name, now members sharing the land use rights of that household have a request to issue a new one to record the full name of member sharing the land use rights of the household.
Eighth is to change the size of the edges, area, and number of the land plot due to measuring and maping cadastral maps, and measuring cadastral records of the land plot without changing the land plot boundary.
