Article 4 of Decree 29/2023/NĐ-CP is as follows:
Object not yet implementing personnel downsizing:
1. Individuals who are currently pregnant, on maternity leave, or caring for a child under 36 months old, except in cases where the individual voluntarily implements personnel downsizing.
2. Individuals who are currently under consideration for disciplinary action or criminal prosecution, or are being investigated due to suspected violations.
Thus, according to the regulations, personnel downsizing has not been implemented for female civil servants at the commune level in the following cases:
(1) Female civil servants at the commune level who are currently pregnant, on maternity leave, or caring for a child under 36 months old, except in cases where the individual voluntarily implements personnel downsizing.
(2) Female civil servants at the commune level who are currently under consideration for disciplinary action or criminal prosecution, or are being investigated due to suspected violations.
