In recent days, social networks have been bustling with the fight after the breakup between streamer ViruSs and hot TikToker Ngoc kem.
After nearly a year of dating, Ngoc kem livestreamed at midnight accusing ViruSs of being unfaithful. She even hinted that ViruSs had a child, causing public criticism and mockery of this streamer across social networks.
The livestreams fighting back and forth between the two main characters became the focus of discussion on social networks. Being attacked and boycotted, ViruSs affirmed that Ngoc kem had 2 days to apologize and correct, otherwise he would sue for defamation and slander.
Previously, many cases of TikToker, a famous person spreading shocking news, affecting the honor of individuals and organizations have been strictly handled according to the provisions of law.
Talking to Lao Dong reporter, MSc. Le Dinh Quyet - lecturer at Hanoi Law University, senior advisor at LVI Law Firm - said that the attacking behavior and "exposure" of celebrities on social networks are increasingly complicated, however, many people are still lacking awareness of the consequences.
Experts say that many celebrities and KOLs tend to expose everything online when there are conflicts, disagreements, or frustrations about an issue. When they speak up, their views spread faster, had a wider impact, and were more controversial to the public.
Meanwhile, the crowd mentality on social networks is also a factor that promotes the nature and level of arguments to be more intense and tense, causing many people to fall into a state of online violence.
Vietnamese culture still has a saying, "couples close their doors and say goodbye to each other" meaning that personal conflicts should be resolved privately between individuals related to each other, avoiding complications by dragging each other into the middle of the village to argue.

Putting on social networks the fight and armed struggle is like "standing in the middle of the road", in the crowd, personally exposing their personality and hidden corners in life for the world to comment and convey.
Unpredictable consequences
According to MSc. Le Dinh Quyet, from a legal perspective, the act of posting shocking and slanderous information violates the provisions of the 2018 Law on Cyber Security, violates the honor, reputation, dignity or causes damage to the legitimate rights and interests of other agencies, organizations and individuals.
In the above case, the person who violates honor, dignity or humiliates another person may be subject to administrative sanctions or more severe criminal prosecution and may be responsible for compensation for damages to the person who is offended for honor, dignity, or reputation.
The administrative fine is stipulated from 2,000,000 - 3,000,000 VND for those who provoke, tease, insult, insult, or defame the honor and dignity of others (Point a, Clause 3, Article 7, Decree 144/2021/ND-CP).
Violators may be prosecuted for criminal liability for the following crimes:
Crime of humiliating others: Pursuant to Article 155 of the 2015 Penal Code, anyone who seriously offends the dignity and honor of another person will be subject to a warning, a fine of VND 10,000,000 to VND 30,000,000 or a non-custodial reform penalty of up to 3 years. The maximum penalty for this crime is imprisonment from 2 to 5 years.
Slander: According to Article 156 of the 2015 Penal Code, a person who fabricates or spreads things that are clearly untrue in order to seriously offend the dignity, honor or cause damage to the legitimate rights and interests of another person may be subject to a fine of VND 10,000,000 to VND 50,000,000, non-custodial reform for up to 2 years or imprisonment from 3 months to 1 year. The maximum penalty can be up to 7 years in prison.
Violations of the life, health, honor, dignity, reputation, property, rights, and other legitimate interests of others that cause material or mental damage are also the basis for arising responsibility for compensation for damages according to Article 584 of the 2015 Civil Code.
