Famous songs such as "Welcome Song" (Vo Van Di), "For the People, Forget Me" (Doan Quang Khai), "Doi An Quoc Quan" (Phan Huynh Dieu), "Chiec Gio Truong Son" (Pham Tuyen), "Tien Nhap Nguoc Phuong Tran" (Doan Nho), "Co gai ban chong" (Xuan Giao), "Hanh khuc ngay don don don don don" (Phan Huynh Dieu) ... had good views but were blocked on YouTube.
In mid-May 2025, BH Media submitted a petition to the Ministry of Culture, Sports and Tourism, the Department of copyright, the Department of Internal Political Security - Ministry of Public Security and stated that VCPMC had obstructed the dissemination of revolutionary music works on the YouTube platform.
BH Media said that on YouTube's content management system (CMS), VCPMC has 100% rights to the song "Doi An Quoc Hoa", including communication rights (PR - Performance Right) and copy rights (MR - Mechanical Right).
Depending on the number of views of each video, YouTube pays for the copyright of VCPMC from the system, including PR and MR.
However, BH Media shared that VCPMC continues to require content production units such as BH Media to pay additional copyright fees, collect annual fees to extend, and keep videos on digital platforms.
BH Media called this behavior "uro transparent", "overcharging" and made it difficult for production units to promote the song to the public.
Mr. Nguyen Hai Binh - General Director of BH Media shared: " YouTube is the channel that brings the most copyright to VCPMC and musicians. The collection of overlapping royalties in the long run causes damage to musicians, making production units hesitant to create. Meanwhile, the most important thing for authors is how to make their works known to many audiences. They don't want their song videos to be blocked just to get their copyrights.
In fact, the relationship between the author and the producer and distributor is a symbiotic relationship, developing together. We always respect copyright, however, the protection of copyright in the YouTube environment in Vietnam needs to be transparent and comply with the platform's policies as well as international practices".
BH Media cited the collection of copyright fees by international units such as ICE ( International copyright Enterprise) - a music copyright management organization that includes many large collective rights management organizations (CMO) such as PRS for Music (UK), GEMA (Germany), STIM (Sweden) ...
Organizations and copyright management companies around the world that sign similar partnerships with YouTube VCPMC will receive tac rights from YouTube through content management. These organizations will not block (lock) or Takedown ( Remove) videos to put pressure, forcing channel owners to pay more money as VCPMC does.
According to Point a, Clause 3, Article 20 of the Law on Intellectual Property, copyright owners do not have the right to prohibit organizations and individuals from copying works only to exercise other rights as prescribed in this Law. For example, copying videos posted on YouTube is only for the purpose of playing videos (including works) to audiences on YouTube.
As for VCPMC, on May 15, this unit filed a lawsuit against BH Media at the Hanoi People's Court for copyright infringement. In addition to the lawsuit, VCPMC also requested BH Media to correct the information and publicly apologize for making false statements, damaging the image and reputation of VCPMC.
Lao Dong reporter contacted the VCPMC representative but has not received any response.
Previously, in a conversation with Lao Dong reporter, VCPMC General Director - musician Dinh Trung Can talked about the litigation surrounding the scratch of royalties.
Musicians informed, according to the current law, the responsibility of the copyrighted collective representative organization and the relevant rights in developing the continuing schedule prescribed in Clause 1, Article 43 of Decree No. 22/2018/ND-CP: “The representative organization of the copyright, related rights to build the royalties, remuneration and material benefits prescribed in Clause 3, Article 20, Clause 4, Article 29 of intellectual property law ”.
Mr. Can affirmed that VCPMC always upholds Vietnamese law, respects creative values, legitimate rights and interests of authors and owners of works.
