Sending questions to the Government's electronic information portal, a reader expressed concern about the regulations on tutoring and extra classes.
According to readers, regarding the regulation that teachers are not allowed to organize extra classes outside the school (with fee collection) for "students whom the school is assigning to teach according to the education plan", two opposing understandings are currently arising in the case of teachers teaching "cross-subjects": In case teachers are assigned by the school to teach official course subject A (e.g., Informatics), but this teacher has a legal qualification to teach subject B (e.g., Mathematics).
Teachers want to organize extra math classes outside the school (with fee collection) for the students they are teaching Informatics at the school. The first understanding is that this behavior violates because that student is the subject that the teacher is directly managing and teaching at the school (regardless of subject), collecting fees for extra classes for other subjects still has the risk of conflicting interests or losing objectivity.
The second understanding is that it is not a violation because the teacher does not tutor the subject they are in charge of (Informatics). Students going to study Math is voluntary, teachers do not use Informatics scores to force or oppress students.
Readers request the Ministry of Education and Training to consider and have specific guidance documents on the concept of "teaching assignment" calculated by subject or calculated by student/class so that educational institutions have a basis for unified implementation.
Regarding this content, the Ministry of Education and Training answers as follows:
Clause 4, Article 4 of Circular No. 29/2024/TT-BGDĐT (amended and supplemented in Circular No. 19/2026/TT-BGDĐT) takes the subject of students that teachers are assigned to teach according to the education plan as the basis for determining the scope of application, not determined according to the subject that teachers are assigned to teach or the subject of extra teaching.
Therefore, teachers are not allowed to organize paid tutoring for students they are assigned to teach according to the school's education plan.
This regulation aims to prevent conflicts of interest that may arise from the relationship between teachers and students in the process of performing teaching and educational tasks, ensuring objectivity and fairness in tutoring and extra classes.
