The Ministry of Education and Training (MOET) is seeking comments and completing the Draft Decree regulating penalties for administrative violations in the field of education.
The Ministry said that as of July 6, 2026, the Ministry has received 73 response documents from relevant agencies, units, agencies, and organizations. The Ministry has urgently summarized, classified, and researched to absorb the content, and at the same time provide specific and reasonable explanations for issues with different opinions, ensuring publicity, transparency, objectivity and compliance with legal regulations in the process of completing the draft.
Participating in contributing opinions to complete the draft, the Vietnam Fatherland Front proposed to clarify concepts such as "conflict of interests", "luring students to extra classes against regulations", "forcing extra classes" for regulations on extra teaching and extra classes (Article 23); supplement specific reception criteria or application guidelines to ensure transparency, avoiding complaints and recommendations in the handling process.
This is a content group that receives great attention from society. The draft has supplemented the violations relatively fully, but these are concepts of high qualitative nature, which may lead to inconsistent understanding and application between localities" - the Vietnam Fatherland Front proposed.
Regarding the proposal to clarify the concepts of "conflict of interests" and "forced extra classes" above, the Ministry of Education and Training has reviewed the regulations in a direction consistent with specialized laws.
Regarding the proposal to clarify the concept of "luring students to take extra classes against regulations", the Ministry of Education and Training received the opinions of the Vietnam Fatherland Front, amending the draft Decree in the direction of not regulating this act.
The Vietnam Fatherland Front also proposed that the Ministry of Education and Training supplement more specific regulations for violations arising in the digital environment and digital transformation of education.
According to the Vietnam Fatherland Front, the draft has mentioned online teaching, data management and information security (Clause 3. Article 41), however, in practice, many new acts are emerging such as illegal use of learner data, dissemination of inappropriate learning content on digital platforms, application of artificial intelligence to cheat learning and exams. Therefore, it is necessary to study updating more appropriate sanctions to meet the requirements of state management in the context of strong digital transformation in the field of education.
Contributing opinions to the draft, the Department of Education and Training of Dien Bien province said that point d, clause 5, Article 23 of the draft stipulates "Teachers of public schools participate in managing and operating extra classes outside the school".
According to the Department of Education and Training of Dien Bien province, this content coincides with clause 4 point b, so it is proposed to review and amend to avoid duplication and avoid repeated penalties for the same act.
In addition, point b, clause 6, Article 23 stipulates "Permitting, arranging or agreeing to allow teachers of public schools to participate in managing and operating extracurricular activities outside the school". Dien Bien Department of Education and Training proposes to stipulate and distinguish the violating entities as extracurricular establishments, organizations, individuals organizing extra classes, or teachers.
With the above contents, after receiving comments, the Ministry of Education and Training said that it has reviewed and revised the draft.
