The secondary school where Ms. Tang Thi Diem Xuan (Tra Vinh) works has 2 guest teachers in Civic Education.
Ms. Xuan asked, according to Official Dispatch No. 25/SGDDT-KHTC dated January 4, 2024 of the Department of Education and Training of Tra Vinh province, the remuneration will be calculated as the overtime salary of teachers.
Ms. Xuan asked if such a regulation is correct because Circular No. 44/2011/TT-BGDDT dated October 10, 2011 does not state the remuneration level for guest teachers.
"Is the remuneration for a guest lecture agreed upon by both parties or based on overtime pay? If based on overtime pay, is it calculated based on the salary coefficient and allowances based on the guest lecturer's salary or how is it calculated?"
Regarding this issue, the Ministry of Education and Training responded as follows:
The guest lecturer regime in public educational institutions is implemented according to the provisions of Circular No. 44/2011/TT-BGDDT dated October 10, 2011, amended and supplemented by Circular No. 11/2013/TT-BGDDT dated March 29, 2013 of the Minister of Education and Training. The Ministry of Education and Training requests Ms. Tang Thi Diem Xuan to make a recommendation to the head of the educational institution for consideration and satisfactory resolution.
Rights of visiting lecturers
Pursuant to Article 9 of the Regulations issued together with Circular 44/2011/TT-BGDDT regulating the guest lecturer regime in educational institutions issued by the Minister of Education and Training, it is stipulated that:
Receive wages, salaries, and benefits as agreed in the guest lecturer contract and as prescribed by law.
Participate in professional and technical activities, foster pedagogical skills, be given opportunities to conduct scientific research at guest lecturer facilities, be considered for titles, be considered for recognition of meeting standards and be appointed to the titles of Professor and Associate Professor according to the provisions of law.
Be provided and supported with necessary documents, equipment and working means by the guest lecturer; be evaluated, classified and rewarded if having achievements in educational and training activities according to the provisions of law.
Thus, the salary and wages of guest lecturers for primary school will be based on the agreement between the guest teacher and the guest teaching institution.
