Ms. Lan Anh asked, are teachers entitled to border allowances and long-term allowances during their summer vacation? Is maternity allowance enjoyed?

The Ministry of Education and Training responds to this issue as follows:
The working regime for preschool teachers is implemented according to the provisions of Circular No. 48/2011/TT-BGDDT dated October 25, 2011. Of which, teachers' summer vacation is 8 weeks, receiving full salary and allowances and subsidies. The Ministry of Home Affairs is the agency in charge of advising the Government to issue policies for teachers working in areas with particularly difficult socio-economic conditions (Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government). Therefore, it is recommended that you contact the Ministry of Home Affairs for guidance and answers in accordance with regulations.
The Ministry of Education and Training also said that the special allowance regime for people working in border areas with particularly difficult living conditions is implemented according to the provisions of Circular No. 09/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs.
Accordingly, special allowances are only paid for months of actual work in the area. If she is still working at a school in a border area with particularly difficult living conditions, she is eligible for special allowances (even during her summer break).
The Social Insurance Law does not regulate issues related to preferential allowances for employees in different industries. Regulations on preferential allowances for teachers who are directly teaching in public educational institutions are implemented according to the provisions of Decision 244/2005/QD-TTg dated October 6, 2005 of the Prime Minister and Circular No. 01/2006/TTLT-BGD&DT-BNV-BTC dated January 23, 2006 of the Ministry of Education and Training, the Ministry of Home Affairs and the Ministry of Finance.
