Mr. Bui Duc Manh graduated from a regular university. In 2017, Mr. Manh was recruited and appointed to the position of Grade II Secondary School Teacher, teaching Chemistry.
Previously, Mr. Manh had 3 years and 6 months working as a Chemistry teacher at a private school, paying compulsory social insurance, code 15.113, salary coefficient 2.34.
In January 2023, Mr. Manh was re-ranked as a grade III junior high school teacher (V.07.04.32) because he had not held the rank for 9 years.
Mr. Manh asked: "I have a total of 10 years and 1 month of mandatory social insurance contributions. Can I be transferred to the new grade II secondary school teacher position (V.07.04.31)? If not, how long will it take for me to be transferred?"
The Ministry of Education and Training responded to this issue on the Government Electronic Information Portal as follows:
Clause 12, Article 5 of Circular No. 08/2023/TT-BGDDT dated April 14, 2023 of the Minister of Education and Training amending and supplementing a number of articles of Circulars No. 01, 02, 03, 04/2021/TT-BGDDT dated February 2, 2021 of the Minister of Education and Training stipulating codes, standards for professional titles and appointment and salary arrangement for teaching staff in public preschool and general education institutions stipulates:
"From November 3, 2015 to the effective date of this Circular, in case preschool and general education teachers are appointed to a higher rank after the end of the probationary period or after achieving a higher training level than the prescribed level but have not met other standards and have not passed the exam or promotion review organized by the competent authority, they must be reappointed to the correct rank according to regulations (including cases of recruitment before November 3, 2015 and completion of the probationary period according to regulations after November 3, 2015)".
According to the provisions of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government regulating the recruitment, use and management of civil servants, as amended by Decree No. 85/2023/ND-CP dated December 7, 2023, Mr. Bui Duc Manh's previous working period under a labor contract with compulsory social insurance payment was only counted as a basis for salary arrangement and exemption from probationary regime after being recruited as a teacher.
Therefore, he was reappointed by the competent authority to the professional title of grade III junior high school teacher (code V.07.04.32) in accordance with regulations.
To be appointed to the professional title of Grade II secondary school teacher, he must meet the standards of Grade II and achieve results in the promotion exam from Grade III to Grade II organized by the competent authority.
