Mr. Bui Duy Nam (Vinh Vong) said that the Ministry of Education and Training has issued Circular No. 05/2025/TT-BGDDT (effective from April 22, 2025) regulating working regimes for general education and university residents, clearly stipulating how to calculate the number of teachers per year for general education teachers.
Article 156 of the Law on Promulgation of Legal Documents 2015 stipulates that in cases where legal documents issued by the same agency have different provisions on the same issue, the provisions of the legal document issued later shall apply.
Mr. Nam asked: Is Circular No. 05/2025/TT-BGDDT applied for the entire period of the 2024-2025 school year to calculate the number of periods for teachers or from the beginning of the school year until before April 22, 2025 to calculate the number of periods according to previous documents, then from April 22, 2025 to the end of the 2024-2025 school year (according to the time specified in documents on the time of the school year) according to the new Circular No. 05/2025/TT-BGDDT?
The Ministry of Education and Training responds to this issue as follows:
On March 7, 2025, the Minister of Education and Training issued Circular No. 05/2025/TT-BGDDT regulating the working regime for general education and university residents (effective from April 22, 2025).
Pursuant to the provisions of Point a, Clause 1, Article 5 and Clause 2, Article 7 of Circular No. 05/2025/TT-BGDDT, from April 22, 2025, the number of weeks to calculate the teaching period norm for 1 school year for primary school teachers is 35 weeks.
