According to the schedule of the 8th session of the 15th National Assembly, the draft Law on Teachers will be submitted to the National Assembly for comments and first discussion.
The Teachers Law Project specifies 5 policies, including: Identification of teachers; standards and titles of teachers; recruitment, use and working regime of teachers; training, fostering, treatment and honoring of teachers; State management of teachers. The Ministry of Education and Training is the agency in charge of drafting the Law project.
Compared to the previously published versions to widely collect opinions from all walks of life, the draft Law on Teachers (the version submitted to the National Assembly for comments) has a number of new points, shortening many articles and clauses.
In particular, in Article 31 of the draft Law, there are detailed regulations on retirement at an older age for teachers in public educational institutions.
To have their retirement age extended, teachers must meet the following conditions:
- Teachers with the title of professor, associate professor or doctoral degree and teachers working in specific specialized fields and industries are entitled to retirement benefits at an older age.
- Retirement at an older age is implemented when the educational institution has a need, the teacher is healthy enough, and volunteers.
- When retiring at an older age, teachers do not hold leadership or management positions and are not allowed to retain leadership position allowances.
- Working time upon retirement at an older age shall not exceed 5 years for teachers with a doctorate degree, not exceed 7 years for teachers with the title of associate professor, and not exceed 10 years for teachers with the title of professor.
- The Government will detail the retirement regime at old age for teachers in specific specialized fields and sectors.
Thus, teachers with the title of professor, associate professor or doctoral degree and teachers working in specific specialized fields... are entitled to retire at a higher age. However, this is only done when the educational institution where the teacher works has a need and the teacher is healthy enough and voluntarily extends the retirement age.
