According to the draft Law on Teachers (2nd time), the Ministry of Education and Training (MOET) proposed to include the content on the retirement age of teachers in the law. It stipulates: Preschool teachers are allowed to retire when they are 55 years old and enjoy retirement benefits according to regulations; the retirement age of other teachers is implemented according to the provisions of the Labor Code;
Thus, preschool teachers are proposed to retire 5 years earlier than current regulations.
Regarding this content, according to the summary of explanations and comments on the draft Law on Teachers, the Ministry of Education and Training said that many educational institutions and ministries participated in contributing comments on the issue of teachers' retirement age.
The comments focused on proposals such as: Adding preschool teachers to the list of toxic and dangerous occupations; proposing that special education teachers retire at the age of 55; in addition to preschool teachers who can retire early, the retirement age of other female teachers is 58 years old (instead of 60 years old as present); the retirement age of male teachers is implemented according to the provisions of the Labor Code.
There are opinions that it is necessary to supplement the retirement age for teachers at other levels and that the retirement age for teachers should not be increased.
There is an opinion to add that teachers directly teaching at primary, secondary and high schools (not applicable to leaders) can retire when women are 55 years old and men are 60 years old and enjoy retirement benefits according to regulations.
There are many opinions that teachers of Music and Physical Education should also be allowed to retire early - 55 years old for women and 60 years old for men. Especially for physical education teachers, it will be difficult to demonstrate movements to students if they are over 55 years old.
According to the Ministry of Education and Training, many opinions also proposed that primary school teachers, middle school teachers, and high school teachers should be allowed to retire at the age of 57 for women and 60 for men and enjoy retirement benefits according to the provisions of the Labor Code.
The University of Science and Technology proposed that in addition to preschool teachers, primary school teachers should also be allowed to retire at the age of 55 and enjoy retirement benefits according to regulations.
Regarding the above comments and suggestions, the Ministry of Education and Training said that, taking into account the comments, the Ministry has edited in the direction of adding more teachers to schools and classes for the disabled, and not setting a rigid retirement age but setting a lower retirement age compared to the Labor Code, because there are cases of male teachers, if the rigid age of 55 is set, the pension regime will not be guaranteed when they retire.
The Ministry of Education and Training has revised the regulations on retirement age in the draft Law on Teachers as follows: The retirement age of teachers is implemented according to the provisions of the Labor Code; preschool teachers and teachers of schools for the disabled are allowed to retire 05 (five) years earlier than the regulations on retirement age.
Thus, the latest draft Law on Teachers only proposes that preschool teachers and teachers in schools for the disabled have their retirement age reduced, retiring 5 years earlier than the regulation.
As planned, the draft Law on Teachers will be submitted to the National Assembly for consideration and first comments at the 8th session (October 2024) and considered and approved at the 9th session (May 2025).
