The Draft Law on Teachers (submitted to the National Assembly for first comments at the 8th Session of the 15th National Assembly) stipulates many new points on the rights and obligations of teachers, and regulations on recruiting teachers to meet the specific characteristics of the profession.
Accordingly, the regulations on teacher recruitment in the draft law set out a number of requirements to meet the professional characteristics of teachers, which are different from civil servants in other sectors and fields (public teachers), and different from pure workers (non-public teachers).
In particular, an important adjustment in teacher recruitment is: Recruitment method through selection or examination, in which there must be pedagogical practice. Requiring teachers to have pedagogical practice will help increase the professional quality of those recruited as teachers, choosing the right people for the profession.
The draft also stipulates policies to attract teachers in recruitment and clearly defines those who are not allowed to register for recruitment.
The Government shall specify in detail the conditions, processes, procedures, priority subjects, forms, and contents of teacher recruitment and selection examinations; special recruitment of teachers; and recruitment of foreign teachers.
Clearly define and ensure specificity in the use of teachers
The Draft Law on Teachers stipulates more clearly the situations of using teachers associated with the characteristics of the educational level and training level, including: mobilization, secondment, transfer, inter-school and inter-level teaching.
These policies, especially teacher mobilization, are expected to be the solution to solve the problem of local teacher surplus and shortage in recent times at preschool and general education levels.
According to the draft Law, in case of transferring teachers from public educational institutions to educational management agencies, seniority allowances and preferential allowances for teachers will be reserved for a maximum period of 12 months. After the reservation period, the policies and regimes of the new job position will be implemented.
Do not transfer teachers to female teachers who are pregnant or raising children under 36 months old, teachers in especially difficult circumstances, teachers whose spouses are working in border areas or islands, unless the teacher so wishes; Teachers in the prescribed cases have not yet transferred their work positions according to the provisions of the law on anti-corruption and related laws.
