The Ministry of Education and Training is drafting the Law on Teachers, which includes many policies on salaries and benefits for teachers. One of the proposals that is receiving attention is the policy of extending working time for teachers of retirement age.
Article 50 of the regime of extending working hours for teachers stipulates:
Teachers with the title of professor, associate professor and doctoral degree working at educational institutions may extend their working time from retirement age to teach and conduct scientific research if the educational institution requires and approves, the teachers are healthy enough and volunteer.
The extension period prescribed in Clause 1 of this Article for teachers in public educational institutions shall be implemented as follows:
No more than 5 years for teachers with doctoral degrees;
No more than 7 years for teachers with the title of associate professor;
No more than 10 years for teachers with the title of professor.
The extension period prescribed in Clause 1 of this Article for teachers in private educational institutions shall be implemented according to the agreement between the teacher and the educational institution.
During the extended working period as prescribed in Clause 2 of this Article, teachers in public educational institutions shall only perform professional duties, shall not hold leadership or management positions, and shall not be entitled to retain leadership position allowances; teachers in private educational institutions may hold management positions if they meet the requirements of the educational institution.
The decision to extend the working period of a teacher is sent to the relevant organization or individual at least 03 months before the retirement date.
The Government will detail the contents related to procedures and order for considering extending working hours; policies for teachers during extended working hours.
The draft Law on Teachers consists of 9 chapters and 71 articles, closely following 05 policies approved by the Government in Resolution No. 95/NQ-CP of the Government in 2023. The purpose of building the Law on Teachers is to institutionalize the guidelines, policies and policies of the Party and State on teachers, especially the viewpoint that "educational development is the top national policy", teachers "play a decisive role in ensuring the quality of education"; developing a team of teachers with sufficient quantity and good quality is the focus and continuity; building a team of teachers, creating motivation for teachers, learners and honoring teachers; contributing to perfecting the legal system on education.
As planned, the draft Law on Teachers will be submitted to the National Assembly for consideration and first comments at the 8th session (October 2024) and considered and approved at the 9th session (May 2025).
