Student L.T. D (HCMC) asked, according to Decree No. 238/2025/ND-CP, during the study process, students only studying once again will not be exempted from tuition fees, is that correct, or is it calculated from the time Decree No. 238/2025/ND-CP takes effect?
Regarding this issue, the Ministry of Education and Training said that Clause 8, Article 19 of Decree No. 238/2025/ND-CP stipulates: "The regime of exemption, reduction, and support for tuition fees and support for learning expenses is not applied during the time when learners are disciplined to stop studying or be forced to drop out of school, postponement, continuing education, re-study, or supplementary study.

In case learners have to stop studying; re-study, admission, continuing (not more than once) due to illness, accident or stop studying for force majeure reasons not due to discipline or self-resignation, the head of the educational institution shall consider allowing them to continue studying according to regulations and continue to enjoy the support policies specified in this Decree".
Thus, in case students re-study without force majeure reasons, they are not entitled to tuition fee exemption or reduction according to the provisions of Decree No. 238/2025/ND-CP.
In case of having to retake for force majeure reasons (due to illness, accident...), the head of the educational institution shall consider receiving tuition fee exemption and reduction support policies according to the provisions of Decree No. 238/2025/ND-CR.
