Regulations on organizing tutoring and extra classes in schools

Tutoring and extra classes in schools are not charged to students and are only for students who register for extra classes according to each subject as follows:
Students with unqualified academic results in the last subject of the immediately preceding semester;
Students are selected by the school to foster excellent students;
End-of-grade students voluntarily register for entrance exam preparation and graduation exam preparation according to the school's education plan.
The school organizes for students who are subject to the provisions of Clause 1 of this Article to write applications for extra classes according to each subject in each grade level (according to Form No. 01 in the Appendix attached to this Circular).
Based on the number of registered students, the school develops a plan to organize extra classes for each subject in each grade level.
Requirements in organizing tutoring and extra classes
Class arrangement, timetable arrangement and organization of extra classes must ensure the following requirements:
Tutoring classes are arranged by subject for each grade level; each class has no more than 45 (fourty-five) students;
Do not arrange extra classes alternately with the timetable and do not tutor contents in advance compared to teaching according to the subject program distribution in the school's education plan;
Each subject is organized for extra classes no more than 2 (two) periods/week. In case students who are eligible to register for extra classes according to the provisions of Clause 1 of this Article have extra learning needs exceeding 02 (two) periods/week, the Director of the Department of Education and Training shall consider and decide to allow adjustment of the time for organizing extra classes at the request of the Principal or Director or head of the school.
The plan to organize extra classes and tutoring is publicly announced on the school's electronic information page or posted at the school.
Specific requirements in extra tutoring and extra classes outside of school
Organizations or individuals organizing tutoring and extra classes outside the school that collect money from students (hereinafter referred to as tutoring facilities) must comply with the following requirements:
Business registration according to the provisions of law;
Publicly and regularly update on the electronic information page or list at the place where the tutoring facility is located about the subjects being organized for tutoring; tutoring time for each subject according to each grade level; location, form, time of organizing tutoring and extra classes; list of tutors and tutoring fee levels before enrolling tutoring and extra classes to ensure the participation and supervision of students, families and the community.
Part-time teachers outside the school must ensure good moral qualities; have professional competence suitable for the subject participating in part-time teaching.
Teachers who are teaching at schools when participating in extra classes outside the school must ensure compliance with the teacher's code of conduct according to regulations, are responsible for reporting to the Principal on subjects, locations, forms of extra classes, relationships with the registered business entity of the extra teaching facility, time to participate in extra classes before starting and promptly update when there are changes to the reported content, ensuring transparency, preventing conflicts of interest in extra teaching activities.
