The Branch of the Academy of Public Administration and Management in Ho Chi Minh City has just announced the process of exploitation, recovery and receipt of handover of land and housing facilities of the Lao Student Dormitory at No. 10 Ba Thang Hai Street, Hoa Hung Ward, related to PennSchool Primary and Secondary School.
According to the Branch of the Academy of Public Administration and Management in Ho Chi Minh City (abbreviated as Branch), this facility is an asset invested by the state budget. Based on the policy of the Ministry of Home Affairs and the plan approved by the National Academy of Public Administration, on August 25, 2020, the Branch of the National Academy of Public Administration in Ho Chi Minh City (now the Branch of the Academy of Public Administration and Management) signed a contract with S.D Co., Ltd. (abbreviated name).
The contract has a term of 5 years, from September 26, 2020 to September 26, 2025, allowing Company S.D to use the building as a living room, study room and auditorium.
According to the contract, all renovation and repair activities of the building must be approved in writing in advance by the leasing party and must not change the design, structure, or function of the building.
The branch said that during the bidding, negotiation and signing of the contract, S.D Company did not propose a subcontractor or a third party. S.D Company is the sole leaseholder who has the right to use the assets.
However, through actual inspection on December 28, 2022 and the working session on February 10, 2023, the Branch recorded that PennSchool Primary and Secondary School is directly managing and using the entire building. The project was originally designed with 4 floors but has actually been renovated and used into 6 floors.
Through reviewing the documents, the Branch determined that Company S.D and PennSchool had signed a business cooperation contract from March 19, 2021 to jointly exploit the building. According to the Branch, Company S.D did not notify the management unit of this and at the working session on February 10, 2023, it also did not provide relevant documents as requested.
Since 2023, the Branch has repeatedly sent notices requesting the termination of the contract, cessation of exploitation and handover of public assets. S.D Company has documents explaining and refuting violations and requesting to continue to implement the contract, but has not been approved by the Branch.
After the contract expires, on September 30, 2025, the Branch of the Academy of Public Administration and Management in Ho Chi Minh City and S.D Company will sign a contract termination record.
According to the Branch, instead of requesting immediate recovery and handover, the unit has created conditions for more than 9 months, from September 30, 2025 to July 3, 2026, for S.D Company to proactively develop a relocation plan and handle arising relationships with students and parents.
By July 3, 2026, the two sides will complete the handover minutes. The branch officially receives the entire building, premises and related assets.
After that, at the request of the business, the Branch continued to allow S.D Company to temporarily use part of the ground floor space until the end of August 10, 2026 to handle the final tasks related to parents.
The branch emphasized that temporary lending of the ground floor space is not an extension of the exploitation contract, does not generate the right to use the building after the above time and does not mean approving a third party to manage and use the property.
Previously, on August 24, many parents with children studying at PennSchool System, Ba Thang Hai facility, Hoa Hung ward, were surprised when the school closed on the first day of school.
The case is receiving attention from parents, especially related to the organization of teaching and the plan to ensure students' rights after this facility is handed over to the Branch of the Academy of Public Administration and Management in Ho Chi Minh City.
