The Ministry of Justice has just published documents reviewing the draft law amending and supplementing a number of articles of 10 laws related to security and order. The bill is being considered by the National Assembly under a streamlined process at the 10th session.
10 amended and supplemented laws include the Law on Guard; Law on entry, exit, transit, and residence of foreigners in Vietnam; Law on exit and entry of Vietnamese citizens; Law on Residence; Law on Identification; Law on Forces Participating in Security and Order Protection at the Grassroots Level; Law on Road Traffic Order and Safety; Law on Roads; Law on Management and Use of Weapons, explosives and Support Tools; Law on Fire Prevention, Fire Fighting and Rescue.
The Law on Road Traffic Order and Safety stipulates that when transporting children under 10 years old and under 1.35m tall in a car, children must not sit in the same row of seats as the driver, except for cars with only one row of seats. Drivers must use and instruct on the use of appropriate safety devices for children. This regulation will take effect from January 1, 2026.
Discussing this content in the hall, some National Assembly deputies proposed that this regulation should only be applied to family vehicles, passenger vehicles traveling on highways... At the same time, many opinions said that it would be very difficult to implement if passenger transport vehicles were required to be equipped with child seats.
Regarding this content, the Draft Law amends and supplements a number of articles of 10 laws related to security and order that are expected to be revised as follows: "When transporting children under 10 years old and under 1.35m tall in a car, children must not be allowed to sit in the same row of seats as the driver, except for cars with only one row of seats; drivers must use and instruct on the use of appropriate safety equipment for children, except for passenger transport business cars".
According to the provisions of the Road Law, passenger transport business by car includes: passenger transport business by fixed route, public passenger transport business by bus, passenger transport business by taxi, passenger transport business by contract and new types of passenger transport business according to Government regulations.
