According to Appendix II - List of goods and services priced by the State issued with Price Law No. 16/2023/QH15, "pre-registration fee calculation price" does not belong to this list. However, she believes that this type of price is similar to the prices priced by the State and should be issued in the form of an administrative document for convenience of quarterly adjustment.
However, on November 10, 2025, the Tax Department issued a document guiding localities to develop price lists for calculating registration fees for cars and motorbikes in the form of legal normative documents.

Regarding this issue, the Tax Department (Ministry of Finance) said:
Point a, Clause 2, Article 21 of the Law on Promulgation of Legal Documents No. 64/2025/QH15 stipulates that the Provincial People's Committee shall issue a decision to detail the contents assigned in the legal normative document of the higher-level state agency.
Clause 10, Article 16 and Article 19 of the Law on Organization of Local Government No. 72/2025/QH15 stipulate that the Provincial People's Committee has the task and power to issue decisions and other administrative documents under its authority; and is also allowed to abolish, amend, supplement or replace documents issued by it when they are no longer appropriate or illegal.
According to point c, clause 2, Article 1 and clause 8, Article 1 of Decree No. 175/2025/ND-CP, the People's Committees of provinces and centrally-run cities are responsible for issuing price lists for calculating registration fees for houses, cars and motorbikes as a basis for calculating registration fees according to regulations.
In addition, Clause 3, Article 8 of Decree No. 150/2025/ND-CP stipulates that the Department of Finance is responsible for advising and assisting the Provincial People's Committee in performing state management functions on finance, budget, fees, charges and other revenues under its authority.
The Ministry of Finance has also issued Official Dispatch No. 20176/BTC-CST to the Tay Ninh Department of Finance and the Dong Thap Department of Finance. The Official Dispatch clearly states: To organize the implementation of documents of higher-level state agencies, the assignment of advisory agencies and the selection of document forms are under the authority of the Provincial People's Committee.
