It is information from Mr. Tran Huu Linh - Director of the Department of Management and Development of the Domestic Market (Ministry of Industry and Trade) on the case of a fake milk production line that has been destroyed by the Ministry of Public Security on a large scale, with a turnover of nearly VND 500 billion occurred at Rancha Pharma International Pharmaceutical Joint Stock Company and Hacofood Group Nutrition Joint Stock Company.
Could you tell us how to manage and licenses some items that Rancha Pharma and Hacofood Group have made a mistake in the past time? Is this enterprise under the management of the Ministry of Industry and Trade?
- Pursuant to the Government's Decree No. 15/2018/ND-CP of February 2, 2018, detailing the implementation of a number of articles of the Law on Food Safety, the state management competence for dairy products is clearly identified by each product group and specialized agencies.
Accordingly, the Ministry of Industry and Trade is responsible for managing conventional dairy products, excluding non -nutrient micronutrients, functional foods, or pharmaceuticals with special nutritional ingredients, these products are currently managed by the Ministry of Health.
The Ministry of Industry and Trade has no authority to issue a business registration certificate to the enterprise. The establishment and registration of enterprises' operations are implemented by the Department of Planning and Investment of provinces and cities directly under the Central Government in accordance with the Enterprise Law.
Therefore, the Ministry of Industry and Trade does not carry out the licensing and direct management of products by Rancher Pharma International Pharmaceutical Joint Stock Company and Hacofood Group Nutrition Joint Stock Company.
The Ministry of Industry and Trade can only conduct inspections for these enterprises when detecting signs of violations within the assigned functions and tasks.
With a large number of dairy and food product lines provided to the market, operating in many areas, there are many complex issues that make it difficult for management, the market management agency determines the reasons why?

Thirdly, businesses also hire a number of celebrities, film actors, models that influence society, the online community to advertise and sell directly to consumers through social networking channels such as YouTube, Facebook, Zalo ... to avoid, making it difficult for the supervision and inspection of the authorities.
In your opinion, what solutions need to continue to strengthen the management of dairy and dairy products and food products circulating in the market, prevent and thoroughly handle violations?
The Department of Domestic Market Management and Development will closely direct the local Market Management Departments, strengthen inspection and supervision of circulation activities and distribution of dairy products. Especially in small retail channels, unofficial agents, e -commerce and social networks, where there are many risks of fake goods, unknown goods, poor quality goods.
At the same time, the Department of Management and Development of the domestic market will continue to collect feedback from consumers. At the same time, interdisciplinary coordination with the health sector (for quality, standards and food safety) and agricultural sector (for raw milk and agricultural products) to establish solutions to effectively prevent fake milk and milk that does not guarantee the quality of circulation in the market.
The Ministry of Industry and Trade is conducting a review and comprehensive assessment of the management of goods circulation for milk goods, focusing on identifying holes after distribution. From there, propose to improve the mechanism of interdisciplinary coordination, enhance the effectiveness and efficiency in checking and handling commercial frauds, false advertising, and food safety violations.
