Proposal to fine up to 10 million VND for business households declaring incorrect locations

The Ministry of Finance is proposing to supplement regulations on penalties for some violations of business households.

The Ministry of Finance is drafting a Decree regulating penalties for administrative violations in the fields of investment, bidding, business registration, cooperatives and planning.

The new draft Decree will replace Decree No. 122/2021/ND-CP dated December 28, 2021 of the Government.

According to the draft, violations of declaration of business household registration dossiers and business locations (Article 71) are proposed as follows:

A fine of between 5 million VND and 10 million VND shall be imposed for acts of untruthfully or inaccurately declaring the content of the dossier for registering household business establishment, business location; dossiers for registering changes in the content of household business registration or business location.

In case of tax law violations, handling shall be carried out according to regulations on administrative sanctions in the field of taxation.

Remedial measures are as follows:

Business households must submit new dossiers to replace dossiers that have been declared untruthfully or inaccurately to be considered for issuance of Certificates of Business Household Registration or registration of changes in business household registration content.

Regarding violations of the deadline for registering changes in the content of business household registration, establishing business locations or changing the content of business location registration (Article 72), as follows:

A fine of between 5 million VND and 10 million VND shall be imposed for acts of not registering changes in the content of business household registration; not registering the establishment of business locations; or not registering changes in the content of business location registration as prescribed.

Remedial measures are as follows:

Forced to carry out procedures for registering changes in the content of business household registration, registering the establishment of business locations or registering changes in the content of business location registration for acts violating the provisions of Clause 1 of this Article.

Explaining the above proposal, the Ministry of Finance said that the addition of regulations on penalties for violations in the declaration of business registration dossiers of branches, representative offices and business locations is to ensure compliance with the provisions of the Enterprise Law 2020 and Decree No. 168/2025/ND-CP dated June 30, 2025 of the Government on business registration.

At the same time, supplementing remedial measures to ensure compliance with the law and prevent similar violations in the future.
