This content is stipulated in Article 93 of Decree 168/2025/ND-CP on authorizing the implementation of business household registration procedures.
Accordingly, business households can authorize other organizations or individuals to perform business household registration procedures on their behalf.
Authorization for individuals is not mandatory notarization
In case the business household owner authorizes an individual to carry out business household registration procedures, the registration dossier must be accompanied by a written authorization for the individual to carry out related procedures.
Notably, the power of attorney in this case does not require notarization or authentication.
Authorization for organizations must have service contracts
If the business household owner authorizes the organization to carry out business household registration procedures, the dossier must include:
- Copies of service provision contracts with organizations providing business household registration services;
- Organization's letter of introduction for individuals directly carrying out procedures.
For cases of using public postal services, postal staff when submitting dossiers must include a copy of the dossier submission form according to the form issued by the public postal service provider, with the confirmation signature of the postal staff and business household owner.
In case of using a postal unit that is not a public postal service, the authorization shall be implemented according to the regulations applicable to service providers.
Authorized persons must jointly authenticate electronically
According to Decree 168/2025/ND-CP, authorized and authorized persons must be responsible before the law for the legality, honesty and accuracy of the authorization.
At the same time, both the authorized and the authorized person must carry out electronic authentication to be granted business household registration.
In case the electronic authentication is interrupted, the authorizing officer shall carry out the authentication after being granted business household registration.
If the authorizing person does not confirm or confirms that there is no authorization to carry out business household registration procedures, the commune-level business registration agency will request the business household to report according to regulations.
In addition, if there is no electronic identification account to perform electronic authentication, the business household registration dossier must be accompanied by a copy of the ID card or valid citizen ID card of the authorizing person.
