The Department of Industry and Trade of Lao Cai province has just issued a decision to administratively sanction Yen Phu Joint Stock Company for violating many provisions of the law during the construction and construction management of the lead-zinc extraction factory project in Hanh Phuc commune.
Accordingly, Yen Phu Joint Stock Company (located in Nghia Lo ward, legal representative is Mr. Nguyen Xuan Nhat - Director of the company) was fined for 3 violations.
The first act, the company did not send a written notice of the construction date (attached with a construction permit and design documents) to the local state management agency and the construction professional agency as prescribed. For this violation, the enterprise was fined 7.5 million VND.
The second act, the company started the project without an appraised and approved construction drawing design.
According to the determination, Yen Phu Company has organized the construction of 2 items, including 1 steel frame house, corrugated iron roof with an area of about 600m2 and 1 earthen and stone structure dam, about 25m long - before completing the design documents.
For this violation, the company was fined 70 million VND and forced to immediately stop construction until all appraisal and design approval procedures were completed according to regulations.
The enterprise must also implement a series of remedial measures, including: adjusting the construction project according to the 2014 Construction Law; hiring an independent inspection unit to assess the quality of the project; preparing design documents, reviewing, approving and applying for a construction permit for the two above-mentioned items.
The third act, the company did not send a document requesting the specialized construction agency to inspect the acceptance work according to regulations. For this act, the company was fined 30 million VND.
In total, the three above-mentioned acts caused Yen Phu Joint Stock Company to be administratively fined 107.5 million VND in cash.
Yen Phu Joint Stock Company must strictly comply with the penalty decision. If the deadline is exceeded, enforcement will be enforced, and for each day of late payment, the violating organization must pay an additional 0.05% of the total amount of unpaid fines.
