On March 26, information from Lao Cai Provincial People's Committee said that the Chairman of Au Lau Ward People's Committee has just issued a decision to sanction administrative violations against Minh Nghia Yen Bai Co., Ltd. for violations in construction activities.
According to the decision, Minh Nghia Yen Bai Co., Ltd. (address in Van Yen village, Mau A commune, Lao Cai province; enterprise code 5200798709), directed by Mr. Nguyen Son Ha as Director, legal representative, had the act of organizing construction against the content of the issued construction permit.
Specifically, construction enterprises are subject to preparing feasibility study reports or economic-technical reports for construction investment but do not comply with the issued permit.
This act violates the provisions of point c, clause 6, Article 16 of Decree No. 16/2022/ND-CP of the Government on sanctioning administrative violations in the field of construction.
For the above violations, the enterprise is subject to a fine of 110 million VND, belonging to the penalty frame from 100 to 120 million VND according to regulations.
In addition to monetary penalties, functional agencies request Minh Nghia Yen Bai Co., Ltd. to urgently complete the dossier requesting a construction permit or adjust the permit and construction design in accordance with regulations.
The deadline for implementing remedial measures is 90 days from the date of receiving the decision. The Economic, Infrastructure and Urban Department is assigned the task of supervising and urging compliance and reporting the results to the Ward People's Committee.
The decision also clearly states that if the time limit is exceeded and the enterprise does not voluntarily comply, it will be subject to enforcement according to regulations. At the same time, for each day of late payment of fines, the enterprise must pay an additional 0.05% of the total amount not yet paid to the State Treasury of Region IX.
