On January 22, information from the Lao Cai Provincial People's Committee, the Provincial Department of Agriculture and Environment just issued a decision to sanction administrative violations against Hanoi Housing and Commercial Development Investment and Trading Co., Ltd. for violating regulations in the field of land.
According to the penalty decision, this enterprise has committed the act of converting production forest land to non-agricultural land (not residential land) in violation of regulations, with a violating area of 1,076.3 m2 in Tan Hop commune, Lao Cai province. The violation was determined to have occurred since 2005.
Based on point c, clause 2, Article 9 of Decree No. 123/2024/ND-CP of the Government, the penalty for the above-mentioned act is 15 million VND. Because this is an organization, the fine applied is double, equivalent to 30 million VND.
In addition to the form of monetary penalties, Hanoi Housing and Commercial Development Investment and Trading Co., Ltd. is also subject to remedial measures. Specifically, the enterprise is forced to restore the original state of the land for an area of 609.2 m2 that has been illegally built, including workers' houses, kitchens and livestock barns.
For the remaining 467.1 m2, functional agencies do not apply measures to force the restoration of the current state because the works are built and renovated on the old house foundation of households whose land has been recovered since 2005 to implement the project according to the approved investment policy.
In addition, the enterprise was forced to return the illegal profits collected from the violation with an amount of more than 17.8 million VND. In total, the fine and illegal profits that this enterprise must pay are 47.8 million VND.
