On December 12, information from the Department of Agriculture and Environment of Lao Cai province, the unit has just issued a decision to fine Hoang Phat Mineral and Construction Joint Stock Company (Hoang Phat Company) for using State-managed land for mineral exploitation in violation of regulations.
Hoang Phat Company is headquartered in Group 10, Yen Binh Commune, with Mr. Vu Van Thuc as Director and legal representative.
According to the authorities, from January 20, 2020 to February 22, 2025, Hoang Phat Company has occupied 2.1 hectares of land in the Chay River to exploit sand and gravel.
The location and boundary of the violation are determined according to the coordinates in the Mineral Exploitation License No. 1330 issued by the People's Committee of Yen Bai province (now the People's Committee of Lao Cai province) in 2018.
This land area according to the cadastral records is river land managed by the State (represented by the People's Committee of the commune).
The violation is a case of occupying land managed by a state agency, as prescribed in Point g, Clause 1, Article 13 of Decree 123/2024/ND-CP.
Therefore, the authorities fined Hoang Phat Company 325 million VND for using land managed by the State to exploit minerals in violation of regulations.
In addition to the fine, Hoang Phat Company was forced to return the illegal profits of more than 109 million VND within 10 days of receiving the decision.
In case the enterprise is late in paying the fine, each day will be charged an additional 0.05% of the amount not yet paid and may be subject to enforcement according to regulations.
