Implementing the cooperation agreement between TCP Group Thailand - the manufacturer of Red Bull energy drink - and the General Department of Market Management (GMS), upon receiving the feedback from IP MAX Law Company Limited - the Intellectual Property Representative of the Red Bull brand in Vietnam, the GMS directed the Market Management Department to preside over and coordinate with the Hanoi City Market Management Department and the Bac Ninh Province Market Management Department to carry out inspection and handling activities that affect the reputation of businesses.
On December 3, the Department of Market Management (General Department of Market Management) coordinated with the Hanoi City Market Management Department to conduct a surprise inspection of a beverage business location in Nam Tu Liem District. Here, the inspection team discovered 3,000 cans of energy drinks being consumed in the Hanoi market bearing signs of infringement of the protected trademarks of TCP Group.
During the actual inspection, the inspection team discovered that the violating products showed information that the products were manufactured at a facility in Thuan Thanh town, Bac Ninh province. Immediately upon receiving the information, the Department of Professional Affairs, General Department of Market Management urgently coordinated with the Department of Market Management of Bac Ninh province to inspect the facility producing these violating products on the same day.
Accordingly, on the afternoon of December 3, Inspection Team No. 2 of the Market Management Department, in coordination with the Market Management Department of Bac Ninh province and local authorities, conducted an inspection of the Branch of V.M Food and Beverage Processing Joint Stock Company, directed by Mr. H.T.D.
At the time the authorities arrived to inspect, the factory was still operating normally. At the time of the inspection, the authorities recorded a large quantity of finished products bearing the Red Blue brand, packaged in cartons of the same brand, ready for transportation to consumption. In addition, the factory also stored a lot of unused energy drink cans.
In actual counting, the inspection team recorded 2,100 cartons of energy drinks, equivalent to 50,400 cans of Red Blue branded products being prepared for consumption to serve Tet 2025, along with nearly 114,000 cans of Red Blue energy drinks, and over 37,000 unused cans of Red Best branded energy drinks.
In the initial inspection, the inspection team determined that all the goods discovered by the Market Management Force at the Branch of V.M Food and Beverage Processing Joint Stock Company showed signs of infringing on the rights of registered trademarks.
The inspection team then temporarily detained all the violating goods to continue verifying and clarifying the violations.
