Authorizing mineral licensing, commune level facilitates supervision and post-inspection

Gia Lai - The Provincial Party Committee authorizes communes to have the right to license mineral activities, creating favorable conditions for construction and serving projects in the locality.

Simplify procedures, shorten waiting time

Along with administrative reform, shortening and simplifying procedures, Gia Lai province also promotes decentralization, delegation of power, assignment of tasks and targets to communes.

Recently, the Chairman of Gia Lai Provincial People's Committee signed and issued Decision (No. 2574/QD-UBND dated June 15, 2026) authorizing the Chairmen of People's Committees of 65 communes and wards of the province to pilot the licensing of construction sand and filling land mineral activities.

Mr. Ho Van Thao - Secretary of the Party Committee of Phu Tuc commune, Gia Lai said: "The authorization of the commune to carry out mineral assessment and licensing creates more favorable conditions for construction, construction, leveling and use of minerals and sand in the area.

Previously, this task was advised and evaluated by the Department of Agriculture and Environment and then submitted to the Provincial People's Committee for approval. Now, the commune level will directly assess and appraise the volume of minerals licensed and also manage mineral exploitation activities. Thus, administrative procedures will be much faster and more convenient, to serve people and businesses”.

According to Mr. Thao, if officials in charge in the commune are not familiar with the job, they can hire consulting and supervisory units to perform tasks such as measuring volumes and types, or hire investment project management consultants, bidding, auctions... All can hire external consultants to participate so that professional work and state management can be completed faster and more accurately.

Along the Ba River, the Kon River, one of the largest rivers in the area, flowing through many communes, often carries a large amount of minerals. After rain and floods, sand also silts up into riverside sand dunes, with a scale of thousands of cubic meters.

Therefore, authorizing communes in mineral management and licensing activities will be appropriate to the characteristics and demand for construction materials of each locality, partially limiting the situation of illegal sand mining and illegal land causing tax revenue loss and affecting the environment.

The commune is responsible before the law and the Provincial Chairman

According to Decision No. 2574/QD-UBND, the term for the Chairman of the Provincial People's Committee to authorize the Chairmen of the People's Committees of 65 communes and wards under the province to pilot the licensing of construction sand and filling land mineral activities is 5 years, from June 15, 2026.

Chairmen of People's Committees of communes and wards are authorized to be fully responsible before the law and before the Chairman of the Provincial People's Committee for the implementation of the authorized contents; they are not authorized to continue with the authorized contents.

The Chairpersons of the People's Committees of the above localities are entitled to license mineral activities (mineral exploration, approval of mineral exploration results reports, licensing mineral exploitation and closing mines) as ordinary construction materials (river sand, leveling soil) at mines in the managed area.

The goal is to serve projects in the area, including public investment projects and socio-economic development projects (science and technology; culture, sports; education; health; industrial zones - clusters; projects serving social security; energy; Phu My Port project).

Mr. Nguyen Van Khanh - Secretary of the Party Committee of Binh Khe commune, Gia Lai said: "The demand for leveling and building materials in the area is quite vibrant. Therefore, when there is a decision to authorize, the professional department will study and understand the regulations for implementation. Minerals in the area directly managed, licensed, post-inspected, and supervised by the commune government are always convenient and simplify procedures.

Recently, in Ia Tul commune, floods have silted up agricultural land of Mr. Vo Van Dinh's household, residing in Plei Toan village, creating a large sand yard along the riverbank on a land area of more than 8,000m2. The commune People's Committee quickly determined the volume of minerals recovered is 9,827.52m3, including 2,500m3 of construction sand and 7,327.52m3 of gravel.

Mr. Pham Van Duc - Chairman of Ia Tul Commune People's Committee, Gia Lai province signed a certificate of registration to recover minerals from agricultural land improvement activities for Mr. Vo Van Dinh (residing in Plei Toan village).

Mr. Dinh is allowed to recover the above minerals to improve the encroached agricultural land. The inventory of mineral volume and the implementation of tax and financial obligations will be carried out in accordance with the law.

Thanks to convenient procedures, the source of construction sand will follow transport vehicles to distribute to places that supply basic materials, and at the same time contribute revenue to the state budget.
