The Government has just issued Decree No. 283/2026/ND-CP stipulating penalties for administrative violations in the fields of labor, social insurance and Vietnamese workers going to work abroad under contracts. The Decree takes effect from September 10.
According to the decree, organizations and individuals with administrative violations in the above-mentioned fields are subject to penalties in the form of warnings or fines. Depending on the nature and severity of the violation, violators may also be subject to additional penalties such as confiscation of exhibits, revocation of the right to use professional certificates for a limited time, suspension of operations for a limited time or deportation of foreign workers working in Vietnam.
For violations of regulations on recruitment and labor management, the decree stipulates a fine of 50-75 million VND for organizations and individuals who act to lure, seduce, promise, advertise fraudulently or use other tricks to deceive workers or recruit workers for the purpose of exploitation and forced labor but not to the extent of criminal prosecution.
Employers who collect money from employees when participating in recruitment will be forced to return the entire amount collected.
The Decree also stipulates a fine of 5-10 million VND for acts such as discrimination in labor; using untrained labor or without national vocational skills certificates for mandatory jobs; not reporting changes in labor according to regulations; not establishing or establishing labor management books not on time, not ensuring content according to regulations.
