Article 4 of Decree 131/2026/ND-CP detailing Clause 3, Article 160 of the Law on Juvenile Justice on the use of funds from the Children's Fund for minor victims (effective from May 25, 2026) stipulates the conditions for using funds from the Children's Fund for minor victims as follows:
1. The use of funds from the Children's Fund is carried out when the following conditions are met:
a) Minors who are victims of life and health violations who are in an emergency situation and need to be treated at medical examination and treatment facilities to prevent serious consequences;
b) The compensator cannot make immediate compensation.
2. The compensator who cannot immediately make compensation as prescribed in point b, clause 1 of this Article is the compensator who falls into one of the following cases:
a) Poor households;
b) Near-poor households;
c) Died;
d) Running away or not yet identifying the perpetrator of the crime.
Article 5 of Decree No. 131/2026/ND-CP stipulates the use of funds from the Children's Fund for minors who are victims as follows:
1. The level of funding used from the Children's Fund for minors who are victims of life and health violations that need timely treatment is based on the cost of medical examination and treatment for minors who are victims, excluding medical examination and treatment costs upon request, costs paid by health insurance (if any), but not exceeding 100 times the base salary level prescribed by the State for a minor as a victim.
2. Annually, the Children's Fund prepares a cost estimate to support medical examination and treatment for minors who are victims in the unit's total operating estimate according to current regulations.
Thus, from May 25, 2026, children who are victims of life and health violations may be supported with emergency costs up to 100 times the basic salary level according to the above regulations.
