Clause 1, Clause 2, Article 37 of the 2025 Law on Employment (effective from January 1, 2026) stipulates the cases in which employees are supported to participate in training and improve their vocational skills as follows:
1. Employees receiving unemployment benefits are supported with training and vocational skills improvement.
2. In case the employee is not a subject specified in Clause 1 of this Article, he/she must meet the following conditions:
a) Belonging to the subjects specified in Point a, Clause 1, Article 38 of this Law;
b) Having submitted a request for training support and vocational skills improvement within 12 months from the date of termination of the labor contract, employment contract or termination of employment;
c) Within 10 working days from the date of submission of a complete application for training support and vocational skills improvement for employees who are not employed and are subject to compulsory social insurance as prescribed in the Law on Social Insurance or perform military service, service in the People's Public Security, regular militia or study for a period of more than 12 months or comply with the decision to apply the measure of being sent to a compulsory education institution, compulsory drug rehabilitation facility or being detained, serving a prison sentence or settling abroad or dying;
d) Having paid unemployment insurance for 09 months or more within 36 months before the termination of the labor contract, employment contract or termination of employment.
Point a, Clause 1, Article 38 of the 2025 Law on Employment stipulates the subjects as employees "Cessation of labor contracts, employment contracts or termination of employment according to the provisions of law without falling into one of the cases where employees unilaterally terminate labor contracts illegally according to the provisions of the Labor Code or employees quit when they are eligible for pension".
Thus, workers will be supported to participate in training and improve their vocational skills in the above cases.
