That is the content proposed by the Ministry of Health in the draft Decree amending and supplementing a number of articles of Decree 77 2013 and Decree 117/2020.

E-cigarettes are dangerous and harmful to the physical and mental health of users.

There are many types of electronic cigarettes and heated tobacco products containing drugs. Parents are worried that their children will be lured by bad guys, use new-generation cigarettes, and become drug addicts without any good results.

In the article "E-cigarettes brazenly advertised for sale on the online market" published on March 5, 2025, Lao Dong Newspaper provided information on the situation of e-cigarette trading in Hanoi. With just a call or a click, customers can easily buy an e-cigarette even though this item is banned.

In addition to e-cigarettes, many essential oil stores contain nicotine for e-cigarette users.

Because the service of providing new-generation cigarettes is too "abundant" from the store to online, many students, including female students, are lured to use them. Being exposed to e-cigarettes is difficult to remove, it can be more addictive than regular cigarettes.

Therefore, it is urgent to develop regulations to prevent the business and use of e-cigarettes.

However, the regulation to fine from 5-10 million VND for the act of knowingly using e-cigarettes and heated tobacco products at locations under their ownership or managed by themselves without preventing or reporting to competent authorities for handling is not in accordance with reality.

Because not all cases can prevent e-cigarette users. Prevention means not allowing smoking, if encountering a prostitute, it can bring danger to the body.

Moreover, the above regulation is also very vague, how to determine whether a person knows clearly or not that another person smokes new generation cigarettes to be punished. What if the violator says they don't know the person who is smoking an e-cigarette?

On the other hand, which force will inspect and punish those who do not prevent others from using e-cigarettes?

The ban on the production, trading, import, storage, transportation, and use of electronic cigarettes and heated tobacco products belongs to the authorities, not the people.

There are many legal regulations that are not suitable when applied in practice, so it is necessary to reconsider the above regulation.
