On October 16, Le Van Tu (Quang Nam) was temporarily detained for the crimes of humiliating others and fraud.
Le Van Tu had a relationship with Ms. H. During their relationship, Tu secretly used his phone to record sensitive images between the two of them. After breaking up, knowing that Ms. H was about to get married, Tu released a sensitive clip to humiliate his ex-lover.
This is a despicable act, morally unacceptable. Legally, it is an act of humiliation.
Article 155 of the Penal Code stipulates the crime of humiliating others: Using a computer network or telecommunications network, electronic means to commit a crime is punishable by imprisonment from 03 months to 02 years. In this case, Le Van Tu used a phone, posted a clip on social media to humiliate Ms. H, which is too obvious.
But there are other regulations, if causing mental and behavioral disorders of the victim with a body injury rate of 61% or more, the penalty is imprisonment from 02 years to 05 years.
Tu sent the sensitive clip between the two to Ms. H's husband and her husband's family. We don't know what Ms. H's mental state is like yet. Mental disorders are very likely to occur. The extent of the damage still needs to be assessed.
This incident shows that there are many forms of humiliating others on social networks that are not strictly punished by law. There are many people who slander, defame, and make up stories that affect the reputation, honor, and dignity of others.
Social media users do not post clips, have no pictures or evidence, but fabricate bad stories to blame others, that is also a form of humiliation.
There have been many cases where the humiliated person could not defend himself, had no one to protect him, and did not know how to protect himself, so he fell into depression and mental disorders.
There have been many cases of female students committing suicide because of being slandered on social networks. For example, a female student who had just graduated from grade 12 in Thach That (Hanoi) committed suicide because her “nude photos” were edited on Facebook. A female student in Da Nang City almost lost her life after taking sleeping pills because she was slandered on Facebook. A female student in Nghe An jumped into a pond and left a suicide note after a website posted a clip of her and another male student “kissing”…
There are still many victims who endure being slandered, humiliated, and wronged.
It is time to crack down on cases of bullying, especially when social media and technology are used.
