According to the dossier, in the process of evaluating the bidding documents for the Generic drug package under the bidding plan to select drug suppliers for 2026-2027, on February 6, 2026, Thong Nhat Hospital issued a document requesting Phuc Thien Pharmaceutical Joint Stock Company to provide additional documents to serve the ranking of contractors.
By February 9, 2026, businesses will send supplementary documents, along with a scan and Excel file of the list of employees participating in social insurance and health insurance for employees with contracts from 3 months or more and still valid at the time of bid closing.
In this document, Phuc Thien Pharmaceutical Joint Stock Company said that the enterprise has a total of 65 employees, including 20 wounded soldiers and the remaining 45 employees.
The enterprise also explained that 20 workers are war invalids belonging to the group of people with meritorious services to the revolution, who were issued health insurance cards by the State, so they are not subject to compulsory social insurance at the enterprise. Therefore, the company does not make contributions and confirm compulsory social insurance participation for these cases.
On that basis, the enterprise requested Thong Nhat Hospital to approve additional documents to include in the electronic bidding dossier of the Generic drug bidding package.
After the contractor selection process, Thong Nhat Hospital issued decisions approving the contractor selection results for the drug procurement plan for 2026-2027.
On March 5, 2026, the hospital and Phuc Thien Pharmaceutical Joint Stock Company signed a contract to supply drugs according to the winning bid results.
However, then recommendations related to the contractor selection process arose. Thong Nhat Hospital established a Council to resolve recommendations to review the entire dossier and bidding organization process.
Based on the report of the Recommendation Resolution Council, the Director of Thong Nhat Hospital issued a decision to handle violations against Phuc Thien Pharmaceutical Joint Stock Company.
According to the decision, the enterprise violated Clause 4, Article 16 of the 2023 Bidding Law. According to the provisions of this clause, the enterprise committed fraudulent acts including: Forging or falsifying information, dossiers, documents in bidding; Intentionally providing untruthful, unobjective information and documents in interest dossiers, preliminary selection dossiers, business investment project registration dossiers, bidding dossiers, proposal dossiers to falsify the results of contractor and investor selection.
On that basis, Thong Nhat Hospital decided to confiscate nearly 272 million VND of contract performance guarantee money from Phuc Thien Pharmaceutical Joint Stock Company. At the same time, terminate the drug supply contract signed with Phuc Thien Pharmaceutical Joint Stock Company. Ban enterprises from participating in bidding activities for all drug bidding packages belonging to projects and procurement estimates invested by Thong Nhat Hospital for a period of 3 years from the date the decision takes effect.
